General conditions of purchase

The following is the contractual document that will govern the purchase of products through the website www.kannabia.com/es/, owned by Colección Sur S.L. (hereinafter the provider). Acceptance of this document implies that the user:

  1. Has read, understands and comprehends what is set out herein.
  2. That he/she is a person with sufficient capacity to contract.
  3. That he/she assumes all the obligations set forth herein.
  4. That he/she is of legal age.

These conditions shall be valid for an indefinite period of time and shall be applicable to all purchases made through this website.

The provider reserves the right to unilaterally modify these conditions, without this affecting the goods or promotions that were purchased prior to the modification.

It will always be necessary for the user to confirm that he/she is of legal age. If this is not the case, no transaction will be carried out and the user will be invited to leave the site.

Object of the contract

The purpose of this contract is to regulate the purchase relationship between Colección Sur, S.L. and the user when the user accepts the corresponding box during the online contracting process.

The contractual relationship entails the delivery of a specific product in exchange for a specific price publicly displayed on the website.

General information

Both parties are bound by these general conditions of purchase, unless special conditions have been agreed with each individual customer.

Colección Sur S.L. guarantees the quality of its seeds by offering a 90% guarantee on its genetics. It should be noted that the company trades with organic products, and due to the nature of these products the company cannot be held 100% responsible for their use and maintenance, as well as for the conservation and germination processes on the part of the client.

The stock of seeds is strictly controlled and is renewed quickly and constantly, always respecting the curing times. Colección Sur S.L. also carries out periodic germination tests and only markets the results that obtain the maximum guarantee, although it should be noted that we work with live products, and it is impossible, once the product leaves our warehouse, to guarantee 100% of the germination power.

Colección Sur S.L. is not responsible for any illegal use that third parties may make of our product.

Merchandising is also available in our online shop.

Description of products

On our website, we offer a wide range of products organized in the following categories:

All products comply with Kannabia’s quality standards and are intended exclusively for personal, ornamental or collector use, respecting the legislation in force in each country.

Purchase procedure

The purchase procedure may be carried out in the language chosen by the user on the website. This will be indicated before starting the purchase. The prices and delivery conditions on this website will be applied indistinctly to national or international territory and in compliance with Spanish legislation, as the purchase is made in Spain. The currency used will only be the euro.

You only have to select the product you wish to purchase and click on the image to see the characteristics and details of the same and, where you can select the number of units you want to order, you must view prior to purchase all the features of the product in the product description.

Once you have been informed of all the characteristics of the product, if you decide to continue with the purchase procedure, you will click on the ‘add to cart’ button.

All the products included in the ‘cart’ can be eliminated, as long as you so indicate.

If you modify any of the data entered, the summary shown on the screen will change automatically. There is also a space specifically provided for you to make specific comments regarding your purchase.

Despite adding a specific product, you can continue with your purchase, with all the selected products being included in the basket or cart until you click on the button to continue with the contracting procedure.

In order to start the purchase you will have to select between two options: in the first option you will be able to register by filling in a form with a series of data to carry out the registration and subsequently, the control, invoicing and dispatch of the orders. Users who have already registered must enter their username and password to start and complete their purchase. The user undertakes to make diligent use of his/her password and not to make it available to third parties, as well as to notify the provider of the loss or forgetfulness of the same or of possible access by an unauthorised third party, so that the latter may proceed to block it immediately.

Once the user account has been created, you will receive a welcome e-mail confirming its activation.

As a second option, you can make a purchase as a guest without registering as a user.

You will have the option to enter coupon codes if you have them in order to apply discounts. The discount codes can be given to customers, they will have a discount on the new purchase or on the shipping costs and for an expiry period and minimum amount. If the user has a discount code, he/she must include it before making the payment in order to receive the discount before proceeding with the purchase. If you have not entered your discount coupon, the discount will not be applied.

To finalise your purchase, you must first click on the ‘finalise purchase’ checkbox. Delivery of orders

Orders will be sent to the countries indicated in the right-hand menu of the drop-down menu on the website, currently to Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, France, Germany, Greece, Ireland, Italy, Latvia, Luxembourg, Malta, Netherlands, Poland, Portugal, Republic of Cyprus, Romania, Slovakia, Slovenia, Spain, Sweden, Iceland, Liechtenstein, Switzerland, United Kingdom and United States of America.

Orders will be delivered to the home or address freely designated by the user. Shipments will be made via courier or postal service and the delivery time will depend on the selected destination, the provider assumes no responsibility for when the delivery of the product does not take place as a result of the data provided by the user are false, inaccurate or incomplete or any cause beyond the provider.

It may happen that one or more of the products contained in the order placed by the customer are not available at the time the order is placed. In the event that the product selected by the customer is not in stock, the customer will be informed of the new delivery time and may choose to immediately return the purchase amount if desired. If it is not possible to quickly replenish the stock of a product , the amount paid will be refunded directly with the same means of payment or with the one preferred by the customer. The customer or a person commissioned by the customer shall immediately upon receipt check the goods for transport damage and, if possible, request written confirmation from the carrier of any verifiable transport damage to the packaging of the goods.

Customers are kindly requested to check at the time of delivery of the order by the carrier:

  • That the product(s) are not damaged or altered.
  • That the number of items delivered corresponds to the number indicated on the transport document.

In the event that at the time of delivery you detect that the products have been damaged in transport , please proceed to reject the order or contact us as soon as possible via the customer service telephone +34 958 408 892 and/or email: info@kannabia.com in order to manage the incident as quickly as possible.

Price and shipping costs, offers and promotions

Orders include value added tax (VAT) or other taxes that may be applicable, as well as shipping costs (if any) and in any case will be expressed in Euro currency (€). The prices applicable to each product will be applied automatically by the purchase process in the last phase of the same including the costs generated by taxes, transport or other service, so that the consumer can know the total amount and view it broken down before making the purchase.

In any case, the provider’s contracting platform will inform the user, once the purchase procedure has been completed, via email regarding all the characteristics, price, forms of transport, delivery times and date of contracting, and the user will also receive the invoice in electronic format or, if preferred, in paper format.

Methods of payment

The customer’s preferred payment method will be selected from those available:

Case 1: Returns due to withdrawal of purchase

All products purchased on this website may be returned and reimbursed, provided that you indicate your intention to return the product(s) within 14 calendar days of receipt.

The amounts paid for the item(s) will be refunded, as well as the initial shipping cost.

The consumer and user will only bear the direct cost of returning the goods, as permitted by article 108.1 of the revised text of the general law for the defence of consumers and users and other complementary laws. The right of withdrawal will not be applicable to contracts that refer to:

(a) The provision of services, once the service has been fully performed, and if the contract imposes on the consumer or user an obligation to pay, when performance has begun, with the prior express consent of the consumer or user and with the knowledge on his part that, once the entrepreneur has fully performed the contract, he will have lost his right of withdrawal.

b) The supply of goods or services whose price depends on fluctuations in the financial market which the trader cannot control and which may occur during the withdrawal period.

c) The supply of goods made to the specifications of the consumer and user or clearly personalised.

d) The supply of goods that are likely to deteriorate or expire quickly.

e) The supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.

f) The supply of goods which after delivery and taking into account their nature have become inseparably mixed with other goods.

g) The supply of alcoholic beverages whose price has been agreed at the time of concluding the sales contract and which cannot be delivered within 30 days, and whose actual value depends on market fluctuations beyond the entrepreneur’s control.

(h) Contracts where the consumer and user has specifically requested the trader to visit him for urgent repairs or maintenance; if, during such a visit, the trader provides services in addition to those specifically requested by the consumer or supplies goods other than spare parts necessarily used to carry out the maintenance or repair, the right of withdrawal should apply to those additional services or goods.

(i) The supply of sealed audio or video recordings or sealed software which has been unsealed by the consumer and user after delivery.

j) The supply of newspapers, periodicals or magazines, with the exception of subscription contracts for the supply of such publications.

(k) contracts concluded by means of public auctions

(l) the supply of accommodation services for purposes other than the provision of housing, transport of goods, car rental, catering or services related to leisure activities, where the contracts provide for a specific date or period of performance

m) The supply of digital content which is not provided on a tangible medium when performance has begun and, if the contract imposes an obligation on the consumer or user to pay, when the following conditions are met:

  • (1) The consumer or user has given prior consent to commence performance during the period of the right of withdrawal.

The withdrawal period shall end after 14 calendar days from:

  • (a) The day of the conclusion of the contract, in the case of service contracts.

  • (c) In the case of contracts for the supply of water, gas or electricity where they are not put up for sale in a limited volume or set quantity, or of district heating or digital content which is not supplied on a tangible medium, on the day on which the contract is concluded.

The consumer and user will only bear the direct cost of returning the goods, as permitted by article 108.1 of the revised text of the general law for the defence of consumers and users and other complementary laws.

However, we may withhold reimbursement until we have received the goods, or until you have provided proof of the return of the goods, depending on which condition is met first. Upon receipt of the products, we will examine them and will inform you whether or not you are entitled to a refund of the amounts paid for the product(s) purchased, including delivery costs, if any. The return process will be carried out as soon as possible and, in any case, within 14 days from the date on which we were notified of the intention to withdraw.

We will examine the returned product and will inform you by e-mail or telephone within a reasonable period of time whether the product is to be returned or replaced (if applicable). The amounts paid for those products that are returned because of a defect or fault, when it actually exists, will be refunded in full, including the shipping costs incurred to deliver the item to you. The refund will be made by the same means of payment that was used to pay for the purchase or by the means of payment indicated by the consumer in their request. Those returns that arise from an error in the service. In this case, we undertake to exchange the product for another of the same product, provided that it is available. In the event that the exchange cannot be made, the amount will be refunded.

It is understood that the products are in conformity with the contract provided that:

(i) They conform to the description made by us and possess the qualities that we have presented on the website,

(ii) are fit for the purposes for which goods of the same type are normally used, and

(iii) are of a quality and performance that is reasonably to be expected of a product of the same type.

In the event of a defective article and/or product, THE WEBSITE OWNER shall proceed, as appropriate, to the replacement, price reduction or termination of the contract, which shall be free of charge for the CUSTOMER. In the event that for reasons of availability it is not possible to replace the product, the purchase will be refunded in full.

Applicable law and jurisdiction

This website is subject to Spanish law and in the event of any dispute or controversy arising from the use of this website both parties submit to the jurisdiction of the courts of the city of Granada. This clause of express submission to the courts of the city of Granada shall not be applicable in the event of litigation with users of the website who, according to current legislation, are consumers, in which case the provider and the user agree to submit any dispute that may arise from the provision of the products or services covered by these Conditions to the Courts and Tribunals where the user is located.

Likewise, the provider and the user may submit their disputes to the arbitration provided for in the legislation on arbitration and the defence of consumers and users, and to the procedures for the extrajudicial resolution of disputes established by means of codes of conduct or other instruments of self-regulation.
