Is CBD legal?

In one way or another, the cannabis plant is present in infinity of products that the market offers us today. And among all the existing ones, those that include the three magic letters in their striking wrappings stand out: CBD. Cannabidiol.

In food, this cannabis compound is added to multiple preparations, as well as to oils with different concentrations, cookies and even jelly beans. In cosmetics, the same thing happens; it is added to all kinds of creams, balms and even sexual lubricants. And we cannot of course forget the best known way to consume it: smoking it.

These uses are very new ways to use it, and within this novelty it is always emphasised that they are one hundred percentage legal products in Europe.

This article is intended to determine, as accurately as possible, whether such legality can be affirmed as strongly. What, in short, is the legal situation of the CBD in a changing situation.

The regulations are anachronistic, dispersed and changeable since they are surpassed by scientific evidence and because they go against the World Health Organization criteria itself.

The CBD provenance distinctions are artificial and inefficient, since nobody escapes the fact that if the CBD is to be obtained from the leaves not attached to the flowering tops, a greater amount of raw material and resources is necessary. Therefore, it is not the most efficient option.

It is not reasonable to articulate a different system for CBD extracts, allowing or banning it, depending on the leaves from which it is extracted.

Synthetic CBD does not come from plants and is not affected by the provisions of the Convention on Psychotropic Substances of 1971.

The leaves not attached to the flowering tops – like the seeds – could be used directly, without transformations, because they do not fall within the definition of cannabis.

I await the fulfilment of the Von Kirchman curse in regards to the CBD: “Three innovative words of the legislator, and entire libraries become wet paper”, and that this regulation, absurd and dispersed, fades away, goes away, disappears, like tears in the rain.
